Introduction

This website is operated by Coast Cakes Ltd. Throughout the site, the terms "we", "us" and "our" refer to Coast Cakes Ltd.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein.

Please read these Terms of Service carefully before accessing or using our website. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes.

Custom Cake Terms

Deposit Requirements: A 50% non-refundable deposit is required to secure your cake booking with the balance payable upon collection. Where cakes are ordered through our online store, the full payment will be required at the time of ordering.

Cancellation Policy: If you cancel your order within 7 days from the pickup/delivery date then you forfeit your deposit and you will be liable for the full amount of the order.

Collection Requirements: Cakes are to be collected by close of business on the day specified. At our discretion we may store your cake for an additional 24 hours, after this your order will be cancelled and you will be liable for the full amount.

Order Acceptance: Once you or a designated party has picked up the order, it is considered "accepted" - please ensure that everything is correct prior to collection (ie colours and spelling).

Handcrafted Nature: Every order is hand made. Decorative finishes are done by hand and are subject to the artistic interpretation of our expert cake decorators. You may provide us with a photo for inspiration and duplication, however we make no claims for exact duplication.

Error Reporting: Any errors need to be pointed out to us AT TIME OF PICKUP, all attempts will be made to rectify the issue before you leave our shop.

Refund Policy

No Cash Refunds: Due to the handcrafted nature of our products, we are unable to provide refunds or exchanges.

Discretionary Refunds: We may, at our discretion, give you a refund (minus non-refundable deposit). The refund will be given as a gift voucher - no cash/money refunds will be given. You cannot take the cake and have a refund. We will NOT negotiate a partial refund.

Date Changes: Where cakes are ordered through our online system and you have chosen the incorrect date, we will do our best to accommodate date changes where we are provided sufficient notice (minimum of 7 days). If inadequate notice is provided or we are unable to accommodate the date change, you may, at our discretion, be given the option to continue with the originally selected date or a 50% refund except where the order has been fully completed.

Transfer of Responsibility: Once an item leaves our shop it is considered accepted and Coast Cakes Ltd undertake no responsibility for an item once it leaves the store. Please place cakes on the floor of the car or in a flat level boot space. Cakes and cupcakes are to be stored at room temperature unless otherwise specified.

Online Store Terms

Business Registration: The name that will appear on your statement is Coast Cakes Ltd. We are a New Zealand registered business.

Age Requirements: By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Prohibited Uses: You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Security: You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

Stock, Delivery & Damage Policy

Stock Shortages: Despite our best efforts, from time to time it is unavoidable that stock shortages will occur. If this happens:

  • Items may temporarily be put on back order while we wait to re-stock those items
  • Alternatively, substitutions may be made for a similar item (eg; different brands, minor colour variations)
  • We may also, at our discretion, refund you for any items out of stock instead of placing them on backorder

Delivery Address Responsibility: Coast Cakes does not take any responsibility for parcels being misaddressed. All orders are automatically sent with the address provided by the customer during the order process, and we can not be held responsible if the full address is not provided or if it is changed after the fact.

Damage Claims: If your parcel arrives damaged, please keep any packaging and contact us immediately. Any lost or damaged parcels need to go through the standard claims process and we need to know as soon as you do so we are covered by the couriers insurance process. Damages need to be notified within 24 hours of receipt of the parcel.

Returns Policy: Please choose your items carefully, due to our products being food contact items, we cannot take them back if you change your mind (even if unopened). If there is a problem with your order, please contact us within 5 days so we can rectify.

Force Majeure & COVID-19 Policy

Unforeseeable Circumstances: Force majeure includes circumstances that cannot be predicted or avoided, such as illness, loss of life, strike, non-availability of goods/shortage of supply, loss or malfunctions of utilities, fire, floods, earthquake, terrorist acts, breakdowns, labour difficulties, war, civil unrest, law or regulation or governmental authority declaring a partial or full lockdown, quarantine, or any other reasonable cause that cannot be foreseen.

Event Postponements/Cancellations: All deposits, full or part payments for booked cakes are held safe. If the function or event is postponed or cancelled, we do not offer refunds as per the Fair Trading Act. We will provide a credit voucher, valid for 12 months, which can be used for future bookings. No refunds will be provided for rebookings which are then subsequently cancelled.

Custom Items: Where items have been custom made or purchased for this event already, we reserve the right to retain this amount. (Vouchers are non-transferrable to another person).

Disclaimer of Warranties & Limitation of Liability

Service Availability: We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

"As Is" Service: You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind.

Limitation of Liability: In no case shall Coast Cakes Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages.

Consumer Guarantees Act: It is a condition of sale that the Consumer Guarantees Act 1993 will not apply to any goods or services acquired for business purposes. No other warranties either express or implied by law are made with respect to these products.

Payment Terms

Payment Timing: You must pay any amounts due on time, otherwise, we may:

  • Charge you a late payment fee, which reflects what it costs us to recover the money you haven't paid
  • Cancel the order
  • If you have an outstanding debt with us, we may pass that debt to a debt collection agency who will then have the right to collect that debt from you. You will also be responsible for any additional costs arising from recovery of any outstanding amounts

Corporate Orders: Where you enter this agreement on behalf of a company, you represent that you have full authority to act and commit Directors of said company to be held to these terms and conditions.

Uncollected Orders: Orders placed for instore collection that are not picked up within 3 months, will be returned to stock.

Governing Law & Agreement

New Zealand Law: These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand.

Entire Agreement: These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service.

Severability: In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law.

Updates to Terms: You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.
